Why use an EBA
|
To give you a better understanding of why this is important, I'd like to tell you a little story. It's called: One day John and Sally LaSale decided to
sell their home. When they bought the house a few years ago from the listing
agent, their best interests weren't represented and they paid too much.
Now that they are selling they are quite excited because they feel it's
their turn to get the highest price.
Across town at that very moment a young couple, Peter and Joan DeBier are reading a real estate magazine and thinking about buying their first home. They see an ad for a buyer agent, his name is... you guessed it, Moe Munee. The ad states that as a buyer agent Moe can help the buyers every step of the way. Peter turns to Joan and says, "Gee Joan this guy really seems to know his stuff he should be a big help in negotiating the lowest price for the purchase of our home". Joan agrees, picks up the phone and makes an appointment for that evening. Moe shows up in his fancy car and shiny shoes and says, "My job is to help you buy your home at the lowest price possible". Moe continues on about how he will assist them every step of the way and tells Peter and Joan the home he listed last night would be perfect for them. Moe says he would like to set up an appointment," if you could sign this dual agency agreement I will bring you over tomorrow“. Peter and Joan cheerfully agree. So Moe Munee takes Peter and Joan DeBier over to see John and Sally LaSale's house, they like it and ask Moe to help them negotiate the purchase. Moe says, "I'm sorry even though you still have to pay my full commission the dual agency disclosure states I can't fully represent your interests on this purchase“. Peter and Joan are more than a little annoyed but they like the house and come up with an offer for Moe to present. Now Moe takes the offer over to John and Sally and presents it. John and Sally are happy to have an offer and ask Moe to help them negotiate the sale. Moe says, "I'm sorry even though you still have to pay my full commission the dual agency disclosure states I can't fully represent your interests on this sale“. What just happened?

"Don't ever buy a property directly from the listing broker. Having your own agent will help you get the best price and terms. It won't increase your costs, because your agent shares the commission with the listing broker. Lawyers in the same office will not represent both parties in a transaction. Agents in the same real estate office shouldn't either.
